California's Property & Debt Division Laws

California is a community property state, which means that any property that you and your spouse acquired during the marriage is "community property," and any debt that you and your spouse acquired during the marriage is also "community debt."

Under California's community property laws, each spouse owns one-half of the community property and one-half of the community debt, both of which are divided equally.

Separate property on the other hand is anything that you or your spouse owned before the marriage. Separate property also includes inheritances and gifts to one spouse, even during the marriage. Rents and profits from separate property are separate property, and any property you buy with separate property is separate property.

How is community property divided?

Ideally, couples will come to an agreement regarding the division of their property by working out a divorce settlement agreement, subject to the judge's approval.
